1. SCOPE OF APPLICATION

The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributed to self-employment. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the execution of his or her commercial or self-employed professional activity.

2. CONTRACTING PARTY, CONTRACT CLOSURE, CORRECTION OPTIONS

The contract of sale is concluded with Janic Ltd.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any time by using the correction aids provided and explained for this purpose in the order process before sending your binding order. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by email.

We save the text of the contract and send you the order data and our T&C in text form. For security reasons, the text of the contract is no longer accessible via the Internet.

4. DELIVERY CONDITIONS

We offer free shipping within Germany, Austria and Switzerland.
We only deliver by mail order. Unfortunately, collection by the consumer is not possible.

5. PAYMENT

In our shop you can choose from the following payment methods:

Debit or Credit Card

When placing your order, you will need to provide your debit or credit card details. After your legitimation as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

Klarna

Pay in 3 monthly payments. No interest, no fees.

Spread the cost in 3 interest-free payments on purchases up to £X.

Once you've placed your order at Wood o'clock, you’ll be redirected to Klarna, where you'll be asked to enter your card details. To check your eligibility, Klarna will perform a soft search with a credit agency. This will not affect your credit score. You'll pay your first installment when your order is shipped and then you'll be automatically charged every month. Klarna payments make your experience simple, easy and secure.

For payment processing via Klarna, the T&C and the privacy policy of Klarna apply - in addition to our T&C. You will receive further information in the order process.

PayPal

When selecting PayPal at checkout, you will be directed to the PayPal site to complete your purchase before returning to Wood o'clock. If you pay by PayPal, Wood o'clock will take payment at the point your order is placed on our site.


6. RETENTION OF TITLE

The goods remain our property until full payment has been received.

7. TRANSPORT DAMAGE

If goods are delivered with obvious transport damage, please contact and inform the delivery company as soon as possible with a full description of and complaint about the defect and then contact us immediately. Failure to make a complaint or to contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

8. WARRANTY AND GUARANTEES

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
In case of used goods, the following applies: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects are excluded. Defects occurring within one year of delivery of the goods may be claimed within the statutory limitation period of two years from delivery of the goods.

The above restrictions and shortening of the period shall not apply to claims based on damage caused by us, our legal representatives, or vicarious agents
• in the event of injury to life, limb or health
• in case of intentional or grossly negligent breach of duty as well as fraudulent intent
• in the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, insofar as agreed, or
• insofar as the scope of application of the Product Liability Act is opened

Information on any additional guarantees that may apply and their exact conditions can be found included in the delivery box with the product and on special information pages in the online shop.

9. LIABILITY

For claims based on damage caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation
• in the event of injury to life, limb or health
• in the event of intentional or grossly negligent breach of duty
• in the case of warranty promises, insofar as agreed, or
• insofar as the scope of application of the Product Liability Act is opened

In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must ordinarily be expected.

Otherwise, claims for damages are excluded.

10. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS), which you can find here [https://ec.europa.eu/consumers/odr/]. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
